Iraq war contractor says federal government should pay $100 million in lawsuit damages, fees

PORTLAND, Ore. –  An Iraq war contractor that lost a lawsuit to a group of sickened Oregon soldiers has filed a lawsuit seeking to force the federal government to pay $85 million in damages awarded to the soldiers.

Kellogg Brown and Root also asks that the government pay more than $15 million in attorneys’ fees.

The filing in the U.S. Court of Federal Claims alleges that the U.S. Army Corps of Engineers agreed in 2003 to indemnify KBR against “unusually hazardous risks” for its work in Iraq.

Twelve Oregon National Guard soldiers won their lawsuit against KBR on Nov. 2.

The soldiers were exposed to a toxin while guarding an Iraqi water plant that KBR was repairing.

The Corps of Engineers declined comment.
