Jury has spoken in KBR case, but that’s not the final word

While a jury in Portland in November awarded $85 million in damages to 12 Oregon soldiers and veterans who sued defense contractor KBR Inc., the case is far from over.

Until the judge enters a formal judgment, many things could happen, including a dismissal of the case on legal or jurisdictional grounds.

That’s what happened, in fact, Wednesday in a similar case in federal court in Maryland, where a federal judge concluded that his court has no jurisdiction over military operations in wartime. KBR’s lawyers think the judge’s analysis should also apply in the Oregon case.
